FSMA allows FDA to collect reimbursement fees for several reasons, listed as follows:
- Reinspection of a registered facility for food safety reasons, not including for technical reasons (e.g., wrong font size on a feed label).
- Mandatory recall, in which the commissioner has issued a recall order, and the firm has not yet complied within the time or manner specified in the order.
- Reinspection of a foreign product at a U.S. port, where, for a variety of reasons, FDA inspectors had to return to complete the inspection (e.g., agent not available) or do a reinspection.
For fiscal year 2018, which begins Oct. 1, the hourly rate is $248 for domestic inspections.
